1Introduction & Scope
Rubicon Marketing ("Rubicon Marketing," "we," "us," or "our") is a digital marketing agency serving businesses along the Northeast Coast of the United States. This Privacy Policy explains what information we collect when you visit our website, contact us, or use our services, how we use and share that information, and the choices available to you.
This Policy applies to rubiconmarketing.cc and any other website, form, phone line, or communication channel operated by Rubicon Marketing that links to this Policy (collectively, the "Site" or "Services"). By visiting the Site, submitting a form, calling us, or otherwise using our Services, you acknowledge that you have read and understood this Policy and agree to the collection and use of information as described here. If you do not agree with this Policy, please do not use the Site or Services.
This Policy does not apply to third-party websites, applications, or services that we do not own or control, even if they are linked from our Site.
2Information We Collect
Information you provide to us
We collect information you voluntarily provide when you interact with us, including when you fill out a contact or intake form, request a quote, book a call, sign up for updates, or speak with us by phone or email. This may include:
- Identity and contact information — your name, email address, phone number, and mailing address.
- Business information — your company name, industry, website URL, marketing goals, budget range, and any other details you share about your business.
- Communications — the content of messages, form submissions, emails, and call notes exchanged with us.
- Billing information — if you become a client, information necessary to invoice and process payment (we do not store full payment card numbers ourselves; payments are handled through third-party payment processors).
Information collected automatically
When you visit the Site, we and our service providers automatically collect certain technical information through log files, cookies, and similar technologies, including:
- Log and device data — IP address, browser type and version, operating system, device type, referring/exit pages, and timestamps.
- Usage data — pages visited, links clicked, time spent on pages, and general navigation patterns.
- Approximate location — derived from your IP address (city/region level, not precise geolocation).
We do not knowingly collect sensitive personal information (such as Social Security numbers, health data, or financial account numbers) through the Site, and we ask that you not submit such information to us through contact forms.
3Cookies & Tracking Technologies
Cookies are small text files placed on your device that help websites function and collect usage information. We use, and permit third-party providers to use, the following types of cookies and similar technologies (such as pixels and local storage):
- Essential cookies — required for basic site functionality (e.g., remembering form inputs, security).
- Analytics cookies — such as Google Analytics, which help us understand how visitors use the Site (pages viewed, session duration, traffic sources) so we can improve it.
- Advertising cookies — used with platforms such as Google Ads and Meta (Facebook/Instagram) to measure ad performance and, where applicable, show relevant ads.
Most web browsers let you refuse or delete cookies through their settings. You can typically find these controls under your browser's "Privacy" or "Settings" menu. Blocking cookies may affect the functionality of the Site or how well it works for you. You may also opt out of certain third-party advertising cookies through tools such as the Network Advertising Initiative or Digital Advertising Alliance opt-out pages.
4How We Use Information
We use the information we collect for legitimate business purposes, including to:
- Respond to inquiries, quote requests, and customer service questions;
- Provide, operate, maintain, and improve our marketing services;
- Communicate with you about your account, proposals, campaigns, and service updates;
- Send marketing communications about our services, where permitted, and in accordance with your preferences;
- Analyze Site traffic and usage trends to improve content, design, and performance;
- Detect, investigate, and prevent fraud, abuse, and security incidents;
- Comply with applicable legal obligations, enforce our agreements, and protect our rights.
5How We Share Information
We do not sell your personal information. We share information only in the following limited circumstances:
- Service providers and subprocessors — vendors who perform services on our behalf, such as web hosting providers, email delivery platforms, scheduling and CRM tools, analytics providers (e.g., Google Analytics), and advertising platforms (e.g., Google Ads, Meta). These providers may only use your information to perform services for us and are contractually obligated to protect it.
- Legal and compliance — where required to comply with applicable law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Rubicon Marketing, our clients, or others.
- Business transfers — in connection with a merger, acquisition, financing, reorganization, or sale of some or all of our assets, in which case information may be transferred as part of that transaction, subject to standard confidentiality obligations.
- With your consent — in any other circumstances where you have given us explicit permission to share your information.
6Third-Party Services & Links
Our Site and Services rely on third-party platforms such as Google (Analytics, Ads, Workspace), Meta (Facebook, Instagram), and our web hosting provider to operate and to measure marketing performance. Each of these third parties has its own privacy policy governing how it handles data, and we encourage you to review those policies directly.
Our Site may also contain links to other websites not operated by us. We are not responsible for the content, privacy practices, or security of any third-party websites. Visiting a linked site is at your own discretion and risk.
7Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide our Services, maintain business and tax records, resolve disputes, and comply with legal obligations. When information is no longer needed for these purposes, we take reasonable steps to delete, de-identify, or securely dispose of it.
8Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect from unauthorized access, use, alteration, or disclosure. These may include restricted access to systems, secure hosting infrastructure, and the use of reputable third-party service providers.
However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security. You provide information to us at your own risk, and Rubicon Marketing disclaims liability for unauthorized access to or use of information beyond our reasonable control.
9Your Rights & Choices
Depending on where you live, you may have certain rights regarding your personal information, including the right to access, correct, update, or request deletion of information we hold about you, and the right to opt out of marketing communications. To exercise any of these rights, contact us using the details in Section 14 below, and we will respond within a reasonable time.
California residents (CCPA/CPRA)
If you are a California resident, you may have the right to know what personal information we have collected about you, to request deletion of that information, to correct inaccurate information, and to opt out of the "sale" or "sharing" of personal information (we do not sell or share personal information for cross-context behavioral advertising in the manner that would require an opt-out, but you may still submit a request). You may exercise these rights by contacting us at the email or phone numbers listed in Section 14. We will not discriminate against you for exercising any of these rights.
Users outside the United States (GDPR-style note)
Rubicon Marketing is based in, and primarily serves clients within, the United States. If you access the Site from the European Economic Area, United Kingdom, or another jurisdiction with its own data protection laws, please be aware that your information may be transferred to and processed in the United States, where privacy laws may differ from those of your home jurisdiction. If applicable law grants you rights of access, rectification, erasure, restriction, portability, or objection, you may exercise them by contacting us as described in Section 14.
10Children's Privacy
Our Site and Services are directed to businesses and individuals over the age of 18 and are not intended for children under 13 (or under 16 where applicable law requires). We do not knowingly collect personal information from children. If we learn that we have inadvertently collected information from a child in violation of this Policy, we will take reasonable steps to delete that information promptly. If you believe a child has provided us with personal information, please contact us using the details in Section 14.
11Marketing Communications & Opt-Out
If you receive marketing emails, texts, or calls from us, you may opt out at any time by following the unsubscribe instructions included in the communication, replying "STOP" (for texts), or contacting us directly using the information in Section 14. Please note that even if you opt out of marketing communications, we may still send you non-promotional messages related to an active project, invoice, or service request.
12Do Not Track
Some browsers offer a "Do Not Track" (DNT) signal. There is currently no universally accepted standard for how businesses should respond to DNT signals, and our Site does not currently respond differently based on the presence of a DNT signal from your browser.
13Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Site or Services after any changes take effect constitutes acceptance of the revised Policy.
